his gives a little further on, after he has spoken of speaking
the second of the two clafses of convicts - the untransportable
ones: for, these reasons are such as apply with equal force
and efficacy to the first clafs: and are plainly considered
as applying alike to both.

What then are the persons thus excepted by Duke
out of the persons of this first clafs (transportable Convicts)
destined for the Penitentiary Establishment by Parliament ?
They are neither more nor fewer than all "such transportable
"convicts as the several jails of the respective Counties "can "con
"tain from the time of their receiving sentence till an oppor-
tunity may offer for their being transported". All these per-
sons whom the Secretary of State is so determined to except,
Parliament without any exception authorizes the judicial autho-
rity "the Court" in each case to consign in any number to
the Penitentiary House or Houses "to be evicted as soon as conve
niently may be" requiring of course that same authority, to
consign them, either to that same establishment when instituted, or
at any rate to some one of the two other establishments (the
Transportation establishment or the Hulk establishment) already
instituted by Parliament for this clafs of Convicts: and by this
Act neither requiring, nor so much as authorizing the Court
or the Duke or any body to consign a single one of these
Convicts to any one of to which that by...they shall be consigned in spite of Parliamentthese County Jails.. All these persons
the Duke, with this Act before his eyes, determines-declares
at least his determination - to consign to these County Jails
and not to suffer a single on of them to be consigned either
to the Penitentiary system, which, though Parliament had so long
