Of Punishments In General.
Offender in no case he permitted to selain the pecuniary
Profit or any the least fast of the pecuniary profit he has
made by the Offence; therefore if it appears that a profit
to such or such an amount and no more has been reap—
ed from the offence, let the fasties he obliged to
refund
to that amount; if the amount does not at first appear
let the Judge leave no lawful means untied till he has
satisfied himself what was the amount.
Example.. As if a ministers of Justice endeavouring to search
a mains House for contraband good is forcibly present—
ed or opposed insomuch that he can neither seized them
nor afientain what quantity of them then is. In such case
the Offenders might be a gainer by his Offence, if he was were
only punished by for the opposition gives to Justified. So pre—
sent this let him by all means be made to discover
what quantity of such good these were.
