As to the relative necessity of this piece
in the mechanism of the English law in its present
state, it affords the strongest proof of its natural
repugnancy to the ends of justice and in particular
of its relative unfitness, with reference
to the footing upon which the general fabric of the
law promises to stand in France.
What makes it so necessary in England? the
protection it affords against the tyranny of bad
laws: of bad corrupt branches in the main body
of the laws; in other words the chance it affords
helps to afford of putting a bar to their execution.
