Punishment

Seventhly, it mustmust be on account of some act

the negative; an act of commission, or an act of omission

punishment, in other words to operate as one in a
chain of motive which prompt a man to inflict punishment
as the other.

Eighthly, it must be on account of some act that
appears to have has been done. But it matters not whether the act that
appears to have has been done was of the exterior or overt, or only of
the interior kind!! Mere internal acts, bare intentions
may are as capable of creating a demand for punishment
as the overt acts in which those intentions would
have terminated had they been carried into effect.a

Ninthly, it must be on account of some act that (at
least) appears to have been done. But whether it
be such an act as appears to have been done or
any act actually was done is not material

— NOTE (a) It may be asked, by way of objection, how the intentions
can be punished if not known, & how they can be known
if not manifested by any overt acts. can be made known

by nothing else. The answer is, no more certainly they can not, be known unless manifested
by external acts of some kind or another. But
the acts by which they are manifested may be such as in
themselves would not create any demand for for punishment. In such
