crime so, hand as unwarrantable act
without a vitious evill is no crime at all . So
that to constitute crime against human Laws
there must be, first, a vitious will; and secondly
an unlawful act consequent upon such notions
will — In vain then is the benefit of a Trial
by a Jury pretended permitted to be allowed to the supposed
offender, whom the only circumstance
upon which his guilt [in fact] depends is not
left to them to decide upon — If facts circumstances<add>matter</add>, about
which there is seldom any diffinitly or dispute
as the fact of publication, and the application to the persons supposed to be
objects of that
censure which
the work contains are alone permitted to effect consideration;
while the question of the situation, the most litigated
of all, the main upon which the terms, is
not only not left diverted from the proper Tribunal to the JUry to decide upon, but
at once decided without argument or examination
against the ft by what is called a presumption
the Law?
