Of the evil resulting
from non pursuance
of notice the burthen to
be borne according to the
blame. If no blame to
either party — by both
parties according to
pecuniary circumstances.

Of any evil consequences which may have from
non-pursuance resulted in <del. a party on either side from
non-pursuance of notice, the burthen will be borne
according to the blame: if the blame be inter exclusively on the
part of any party, the burthen will be borne exclusively
by that party: if there be no blame on the
part of any aprty, the burthen will be shared divided<?add>
between him or them on <add>the one side and him or
them on the other, saving any such difference as there>;b/>may be reason to make on account of difference
in respect of pecuniary circumstances: if there be
blame on both sides, the burthen will be divided
in proportion to the degree of blame

Art. 2. The length of interval of notice
will be measured not from the day on which the
notice informative advertisement issues but from the day on which it is received:
the receipt being ascertained either from
direct and positive evidence, or from plain
circumstantial evidence as in the case where means
of appropriate future communication having been settled
the instrument of notice has been delivered in the
manner on that occasion agreed upon.
