Supplemental Observations As to the (?) B supposing if even ever so doubtful whether the clause respecting the acceptance and appointment of an Assignee of their nomination would be binding in their favour they had rather take it subject to that doubt than be sent in quest of an alternative.

As to their Lordships the signing an instrument with a clause so worded, even under such a doubt, would be no imputation upon them. Valid or void, it is no assumption of illegal power to the prejudice of any body: the prejudice, if any, falls upon those, & those only, who petition to stand exposed to it.Mr (?) General therefore, by making his amendment absolute, will not expose his Clients to the smallest risk or imputation. What is it their Lordships are made to engage for? Humbly to recommend to His Majesty to appoint a person nominated by the Contractor, should that person be deemed a fit one by His said Majesty, who when he has received the recommendation is left at liberty to pay what regard to it he thinks fit. As to (?) B reposing themselves on the good faith of Government they feel very little about the question of law. With those sentiments it would be hard upon them indeed, if because one of the two securities cannot be given, the other should be refused.
