Theft Embozzlement and Fraudulent obtainment
Theft domestic If a favourable opportunity of stealing without being
apprehended detected happens to a man who is disposed
to steal , he will steal although he be a stranger
[and not a servant] : if not, he will not steal
although he be a servant.
There are opportunities of stealing things
in fields more favourable than any that
are apt to happen to a servant . Qu - of
this on account of both , as ploughs &c
or smallness of value is old cloaths & — But
Qu - of Cattle.
The penalty must in all crimes at any rate
be as great as it is necessary it should be to
outweigh the ordinary profit of the offence . Why
here in particular should it be greater?
It will only drive thieveth servants to steal
from other masters, ex. g: the friends of their masters
no advantage will be gained by this.
