offence may have a motive to counter-act
it. True it is that this expedient will not
always be of use. Then Very commonly, perhaps most commonly a man who stands is activated
by a vague desire of gain, and goes to sets out
work upon with the ste principle of stealing what
he can. In this case the effect of a proportionable
punishment is not much to be depended
upon. He would not have stolen any part of
what there is before him if he had not thought
the opportunity a fair one: and as it is a
fair one for one part it is as fair an one
for another. But it happens also sometimes
that it is for the sake of satisfying some
particular specific want the importunity of which is
too strong for him to resist: in such case
a proportionable punishment will have its use
A man trader wants a particular sum to keep up
his credit on a particular occasion conjuncture: if he can
not weather out that conjuncture, he is ruined:
if he can, he is secure. To get that particular
sum it will be worth his while he thinks, to
risk any thing: more than that would be
comparatively of no use to him. A man is captivated
