a certain term is allowed to be commuted
into whipping an acute punishment such
as whipping?
Reasons
1. Because otherwise, in the case where the value of the thing stolen was very considerable
the duration of the punishment might be tantamount
to perpetual. Hence would arise two inconveniences: in the first place beyond that amount the offence would have no punishment to counter act it.

Quest. 2. In the next place the punishment might
by this means stand so high as to dispose
a man to give the preference over theft to some
offence still more mischievious; at least unless the
punishment was of all offences liable to come
into competition with this view. these inconveniences are still
more likely to take place,where an offender happens
to have committed a multitude of thefts at
different times before he is prosecuted for one.
