C 47 Theft Embozzlement and Fraudulent obtainment

Theft domestic If a favourable opportunity of stealing without being
apprehended detected happens to a man who is disposed
to steal, he will steal although he be a stranger
[and not a servant]: if not, he will not steal
although he be a servant.

There are opportunities of stealing things
in fields more favourable than any that
are apt to happen to a servant. Qu - of
this on account of both, as ploughs &c
or smallness of value is old cloaths & — But
Qu - of Cattle.

The penalty must in all crimes at any rate
be as great as it is necessary it should be to
outweigh the ordinary profit of the offence. Why
here in particular should it be greater?
It will only drive thievish servants to steal
from other masters, ex. g: the friends of their masters
no advantage will be gained by this.

them on the spot?
