Offences against Domestic Condition - Adultery

Offences may affect a man in his domestic condition
or relation in either of two ways: 1st by depriving
him of that condition itself: 2nd by rendering
it of less value to him; in other words by depriving
him in a greater or less degree of the comforts and benefits [that
bring him he might otherwise have derived from
it.

Domestic conditions are those of
1. Husband or Wife
2. Parent or other relation in the ascending line
3. Son or Daughter or other relation in the descending
line
4. Relations Brother or Sister or other relations in
any collateral line
5. Guardian or Ward.
6. Master or Servant.

Adultery is where either of two or a married
person has carnal knowledge of another person of
the opposite sex; or where any person has carnal knowledge
of a married person of the opposite sex.

If a man without excuse on his part commits adultery with a married
woman without excuse his punishment shall be as
follows
1. He may be fined; and the whole or any part of
his fine may be given in compensation to the
Husband.
2. His In default of payment he may be imprisoned for a proportionable time.
