Commutation of the Punishment. But the Court may if they think proper commute
the Punishment into Fine, with the addition of either Banishment, Imprisonment or Confinement to hard Labour.

Fire-Arms may be employed in quelling Rioters. In quelling Rioters thus persevering after the proclamation
in case of necessity fire arms or other mortal
weapons may, under the direction of the Constable, be employed in the first instance.

Provide these be necessity. It is a case of necessity for example where the
Rioters are so strong either by reason of their numbers
or their arms as to render it unsafe to attack them
in any other manner.
