Every Law whatsoever
either expressly or implicitly
creates or transfers a penalty
therefore to every Law is there a
penalty either expressly or implicitly
annexed.
Strictly speaking all Laws whatever are
all offences against them are Public wrongspenal - even those that carry the least appearance
of being so. [for an example] If the Laws that against
stealing or murder differ have such a difference
from the Laws relating to successions
as to warrant their being formedranged into a
separate classapart [of themselves] it is not because
these are sanctionedfurnished<add></add> with a penalty and
the others are not; nor because
+ the commission of the inspection which these prohibits
+ a transgression of these affect the
community at large while of those only an
individual object, it is only on account
of the quantum of the pain for upon the
influence of which on men's minds the
Law depends for it's execution. in those
for the most it is the pain g<add>uarding the good penalty which the Legislator has principally
which occupies the attention
of the Legislator
in view; and in the increaseenhancement of which consists
the novelty& efficacy of the new establishment:
the good is t?lysupposed to be
already appropriated — in those it is
the novel appropriation of the good in question
which he has in view, and which is formally
denounced by the establishment; the pain
upon which it depends for its execution, is
