Observations
not more than .... nor less than .... for every day omitted: and shall permitt the Clerk, or any 2 Trustees, producing
(if both of them be unknown to such Tollgatherer) an order signed by the Clerk specifying their names and
that they are Trustees, to inspect such account at all reasonable hours, on penalty of not more than ....nor
less than ... for refusal."
The Mortgagees would recover no prejudice form this, the Tollgatherer being accountable to them for what he
receives. The Trustees are interested in the choice of a proper person, by the interest they shall have in the suffisney
of the fund. If thought necessary, an Appeal might be given from their appointment to the Quarter Sessions
The condition of a Road must indeed be deplorable enough, when once it comes to this. In the Trustees
there is an interest to keep it up, but the fund is gone: In the Mortgagees there is a fund towards keeping
it up, but there is no interest. All in dependence is upon the small pittance of work that it is entitled to
from the Parish; & the very trifling &accidental revenue from delinquent's fisher. Might it not therefore be of
use to secure for the future) at all waste a certain proportion of the Tolls to it's benefit. a 3d part for example
or a fourth. The obvious objection to this is, that it would deter people from lending their money: but
though the insolvency of a road is always a possible event; few, I believe, lend their money in the expectation of it:
