[ 12 ] Discretion - Precedents - 2 In regard to Letters of Post Horses In 25 G. 3. c. 51 §. 24. it is provided
" that in case of an evasion therein mentioned practiced by a letter of
Post-Horses
" the . . . Commissioners shall, if they think
"fit, after conviction of such Offender, refuse to grant such
"Offender any licence in future." This is the only instance
I know of, of a

Precedents. 1. In the regard to Hackney Coach Keepers, by 24 G. 3. Sess. 2. c. 27. §. 3. Power is given
to the Commissioners of the Hackney Coach-Office, in case
of the contumacy on the part of a Coach-keeper,
to revoke his licence, and licence another person in
his room.

3. In the case of regard to Hawkers and Pedlars
the Ac by 7 G. 3. c. 43 and 279 G. 3. c. 26 §. 10. 13. the licence is made
forfeite declared to be forfeited, and in the two latter instances
necessarily superadded, on conviction of so many the specific
offenses therein mentioned.

But I know of no instances cases in which the granting
or withholding the licence is made discretionary, or appears
to be intended to be discretionary, except unless it be on conviction
of a specific offense, except that of Ale-house
-keepers. But this power being of the very essence
of the measure Bill, and at the same time a strong and
formidable one, it seemed better to give it in this
manner in the way of reference, than in any direct
way, as in the case of Letters of Posthorses as above
mentioned: expecially as the precedent thus referred to is an extraord a measure
depending on the same principle, a measure universally known, and which appears to be
as universally approved. reg looked upon as a very beneficial
one.
