Of Theft or Stealing

[{} If any one Je] Otherwise thus -
For theft the punishment shall be as follows:
1. Penance more or less public. This at all events.
2. Penitential Imprisonment for not longer than
four weeks. This at discretion.
3. Confinement to hard-labour for three months
certain : and besides that for the space of a day
for every six-pence of the value of the thing
stolen.

Why hard labour is made an article in this
punishment for theft?
Reasons
For the sake of analogy,See Introd. Tit [Properties]
or the or the love of case is most consistently the motive
by which men are led to the commission
of this offence. This and pecuniary interest or
as it may here be called avarice covertousness are almost
the only motives from which it ever takes its raie.
It may be ascribed to avarice ideas when, a
man could have got the thing in question by his
industry if he had chosen to exert it: to covertousness added textwhen
