Why self-preservation from immediate want is made
a ground of Extenuation.

1. Because, taking the fact of the extenuation for granted, the punishment
must be inefficaceous. See Introd. Ch [Cases unusual ]

2. Because it distracts from the secondary mischief
of the offence: from the alarm and from the
danger. From a man's being in such
necessity at one time it follows not that he will
be in the same necessity continually: and from
his stealing when at a time that he has this motive to urge
him it follows not that he will steal when
he has it not.

3. For the satisfaction of the people. The circumstance
which give rise to the offence saves their
compassion for the offender: as which compassion
when the case is strong will rise so high as to
get the better of their resentment. If the law punishes, for cases against

punishment administered by the law goes beyond that which their
punishment would suggest it is apt to change sides. and point itself against the law.
