Examples why
taken mostly from
the English law
In most law systems of law there is a
secret history which differs more or less widely
from the public history one . The laws are seldom
either so good or b so bad in effect as they seem
to be upon paper.
The sphere of indirect legislation will be found
to be immense in detail but still included within approximated by
certain bounds.
In regard to laws The reason which ought to be the first thing that is known about them , is but
too often the the last thing of them about them that is known
of concerning them. This is the grand desideratum in the la regulations here reported referred to or
suggested the reason is what nobody can be at a
loss for: it is the first object that presents itself:
it forms the title of each chapter, and
stands places itself at the head of every paragraph and determines
the order of the whole

The reason of the law is a problem which
regard to many of those laws which on account
of their antiquity we are accustomed brought to
admire learned and ingenious men of learning men have for ages put
themselves to discover to the history , and in vain. Montesquieu
has been thought to have distinguished himself in this line.
If he has succeeded well things have succeeded proportionably
ill. The mint of the legislator and that of the commentator
are in the ratio one of them of the other.
