C 114 Of Theft or Stealing Aggravations are 1. Irreplaceability

Aggravation 1. Thing irreplaceable per se 1. When the thing taken is irreplaceable:
which it may be either 1. in its own nature; or 2. by accident.

Irreplaceable A thing may be said to be irreplaceable
in its own nature when over and above it's
ordinary saleable or current value, it is of those
sorts of things which are likely to have a value
attachment of affection or by or through or from affection or attachment affection Pretium affectionis in the Roman Law; insomuch that when lost it cannot
be made good or replaced by a thing of equal price.
As a family picture, a family pedigree, a family
monument or other memorial: an unpublished
work in manuscript: trees planted for shelter,
shade or prospect.

Punishment In such cases an extraordinary value may
be assigned to it at the discretion of the Judge:
and in consequence the confinement may be extended
to any length of time even so as to be
perpetual or even to perpetuity.

Note Irreplaceable from to replace. The term is itself
a new one: but new ideas demand new terms. The
derivation of it is analogous to that of irretrievable,
irreparable, and several others. Or one might say
unreplaceable.
