As an instance of an act of preparation which
falls short of an attempt take the following, [which
relates to homicide.] A soldier at a review puts a
bullet into his gun: he is discover'd, before the
word is given to fire. This may be deemed an
act of preparation: had he actually fired at any
particular person or assemblage of persons it
would have been an attempt.
