It is only where the supposed impropriety of the
transaction whatever be the assumed standard of propriety and impropriety rises to a certain pitch, that prosecutions
can by any body man in office be regarded as at all in any degree likely to take
place. In regard relation to all modes and degrees of impropriety
beneath that pitch, the check constituted by
fear of punishment is thus altogether without effect.

the use of publicity is not confined to the strength
it gives to the check constituted by the fear of ill repute.

Even where prosecution is not thus laid thrown/add> altogether out
of the question, the improbability of punishment, and
consequently the <add>strength of
check constituted by the fear of it is diminished
by every difficulty that stands in the way
of prosecution: by every course of exclusion whereby
this or that individual is stands excluded from the facility of taking upon him the station
of prosecutors: and thus whether the exclusion be direct
or indirect. Direct, by prestin reputation avowedly
directed to that end; indirect, as by every factitious encrease given
to the wither the t expence, or vexation i.e. the trouble attached incident to
that station and attached to it.
