12. C Of Theft or Stealing Aggravation II Aggravation 2. Where the thing taken is irreplaceable by accident
Exposition

Accident A thing may be said to be irreplaceable
by Accident, when although it is in itself of those
sorts of things which are of a marketable nature,
yet owing to particular exigencies emergencies it possesses an
extraordinary nature. As if the case were that from the
want of something of the sort some great mischief
is likely to ensue, and yet there is either
no more or not enough to be had of the same
sort at the time and in the place in question. For instance corn
or other provisions, gunpowder or other military stores,
mercury, peruvian bark or other specific medecines
in a secluded island or a town invested by
an enemy.
