Review of Sugden

Hitherto I have said judge made law; but this appellative
favorable as it is is still too favorable. Taken in the
strict sense judge made law would be the work either of
a monarchy or an oligarchy, according to the judicatory.
But in fact at the far greatest part of it has been the
the work of three estates: Judge or judges, one; Notetaker, two;
Publishing bookseller three: any one of the three judicatories
failing either the bill is not brought in or if brought in it
is lost: Unless a not taker is present
