Despotism
My Lord if the pretence of seeing in an Act
of Parliament what is not there is to be allowed
– and on under colour the strength of that pretence men are
to be suffered to be turned into wash paper
if at no other expence than that of an
undetectable lie, the Executive power is to be
suffered – and suffered whenever it pleases
and as often as it pleases to tread upon
the work of the legislative – the Constitution
is at an end.
The Act⊞ ⊞ the Penitentiary Act, in prescribing the part to be taken by the Treasury in the institution of an Establishment says required – The Finance Committee
taken notice of its having said required
– and up after this my Lord – and after I
had told him of this – his man in office
had the effrontery to maintain to me insist upon it to my face join me
that it was and always was and could be in their power to do it or
not to do it – as they pleased. My Lord
I know it – and know it but too well, it
has been so by abuse – but if that abuse
is to go on – and precedents are to be made to stand in the eyes of the
public and of Parliament as a precedent from it the Constitution is at an end. For
me Lord if for argument sake it should
be the pleasure of Parliament to bind the Treasury
by what plainer words could they
go about it at it?
