In every state, whatsoever be the constitution of it, monarchical,
aristocratical, democratical, or mixt, there must
to render the government competent to the maintenance of society
in all cases, there must be a facultythere must exist in
some hand or number of hands, a the faculty of operating
with effect and impunity with effect at least, in all manner upon all persons, and in all cases.
Whatsoever person or persons is or are in possession of this faculty
may be said to be the possession of the supreme power in
the state.
