Art 4 In the case where the subject matter is a thing In this case the suit has for its object
the engaging the Judge to take place the subject matter in questing
mode his power for the purpose of re eventually employing applying
the thing in manner as above to the use of the
pursuer in the event of his instituting a suit of the ordinary
cast against the present actual occupant of the thing for the <del.
purpose of its being in the event of his succeeding success in the
suit principal suit as above
