Offences against Condition - Adultery

5. If the Husband, Father or Brother of of the womanFrom p.2
catch him in the fact, or in a situation which affords a probable presumptive proof of the offence, any
such it shall be a justification
any such relation is justifiable tified
in beating him or doing him any other
act to his prejudice which wanted otherwise a consent
to no more than a simple personal injury.

Excuses for Adultery on the part of the woman
may be as follows
Excuses I
1. If the husbands who have for the space of half
a year she has had no tidings of her husband, he
having deserted her without notice.

Excuse II 2. If for the space of three years she has had
no tidings of her husband, he having quitted her
with notice.[a]

3. If within a year he hath lived in open adultery with a woman
in the same house with him

Excuse IV 4. If having been detected in adultery +or on using sollicitations or practicing amorous familiarities with a servant
or other woman whom he has it in his power to remove and being admonished on the part of his
wife he put & not away the adulteress such other woman within
a week after receiving the admonition: cases of necessity excepted.

Excuse V 5. If by solemn agreement or judicial sentence she be already separated from her husband
in bed and board.
