Case where the asserter is a witness
§. 7. Procedure in case of an Offence by falshood
Art. 1. As on the part of a party to the suit so on the
part of an extraneous witness, every act of judicial
mendacity is a punishable offence. For the compensation and punishment
see Ch. §.
Art. 2. So; every act of judicial mendacity insincerity.

Art. 4. On the occasion of any assertion made
whether by a party to the suit or an extraneous witness
the Judge at the instance of any other party to the
suit is bound to declare make declaration of known his
opinion in relation to it, declaring it to be in his
opinion either true or false without blame, or tainted
with mendacity, insincerity or security as above:
and moreover where such opinion has been made
known, he is thereupon at the instance of any party
bound to cause make entry of such his opinion in
the record.
Art. 5. Spontaneously any one of the above condemnatory opinions
may also be declared by the Judge: definitively, if it in
relation to the this imputation, the party being present has been heard in his defence; if not present provisionally
for the purpose of a judicial examination at
a day to be thereupon named if the party be not present.
