§. Extraneous witnesses testimony – how obtainable for the case original
examination.
Art. 1. In regard to extraneous On hearing from any an
applicant On seeing reasons from the examination of an applicant,
reason to believe that by from a certain person as described
evidence material if examined in the oral
or epistolary mode as the case may be, material
evidence may might be collected, the Judge will issue to the
proper officer an appropriate witness-calling testification – call summons requiring instrument order.
Art. 2. If the witness have no domicile in the judicial
district from whence the instrument the
Judge by whom his testimony is required has the options
following –
1. He requests the witness's Judge to convince him
and take his examination on interrogatories suit.
2. He settles with the party by whom the testimony
is required a set of interrogatories which he causes to
be delivered to the proposed witness in person or at his abode habitation domicile.
3. He requires the witness's attendance at the if it
be at the instance of the defendant at the defendant's
judicatory: if at the instance of the pursuer, at the
pursuer's judicatory.
Art. 4. In a certain case the judicatory at which
original examination it carried on or if different the judicatory at which the Quasi trial is carried on maybe the Judicatory to which the witness be longs. This is, where there is
