5. Conciliators Reinquiries
4 If the service demanded is the payment of a sum of money he can do what depends upon him to bring about the result but if it be any other service all he can do is to advise a suit in Equity
Now suppose what the one wants the other to do, and which this other does not choose to do is the payment of a sum of l or not l: in this case, if by the requisite memorandum they have agreed to do what he advises them, in this case he may do what depends upon him to cause to take place what it is his wish to so take place: but if instead of that suit of service what c is the rendering to the party served a sum of money is service in any other shape, , all he can do is to advise them to go into a Court of Equity. Why not? Is not a hundred pounds worth of service shape? Oh but they would be treading upon the toes of other Lord Ch and the Honble and Noble are laying in the there.
5 Without the Judge the parties may be reconciled without expense with him they cannot be but with expense
Without the assistance of the Judge the parties may be reconciled without expense: with it they can not be reconciled but with expense.
6 Judge in Ordinary will he hold the ballance equally No but they will lean to that side which lays down the largest sum of money
