Procedure Code
When they are employed in unison either the oral is
employed before the epistolary written, or the epistolary written before the oral,
in which case it is the interlocutions being usually at a distance, it
is may be stiled the epistolary. More particularly generally conducive in all cases to the
direct ends will the of justice will the oral contiguous followed by the written
be seen to be and that in all cases, to the collateral ends, the epistolary it
being necessarily the written, be the followed by the contiguous oral it being
the contiguous mode, to the collateral ends of justice.
No sooner has any result of the oral mode been produced then
it may be consigned to writing on the spot, and by the interlocutors
themselves, either or both of them: in which case totis though
written it is can not be stiled the epistolary mode. At present An instant
A certain degree of correctness and compleatness is thus immediately secured
to it: and in case of need by subsequent recollection and
reflection and consequent correspondent amendment also in writing
and ulterior degrees of correctness and compleatness may be added
to it.
W Where the distant and thence the written and epistolary is preference employed before
the oral, as much as the interlocutor chooses with
a view to correctness and compleatness, or, if deception be his
object, for incorrectness is deficiency incompleatness in a form adapted
to his purposes, is taken and employed in the first instance.
Thereupon for the better security in favour of correctness and compleatness
causes the use of the oral and thence contiguous mode.
Of any deficiency in either of those two qualities the cause may
be either inattention or sinister design intention.
In either case, the
fear of expence by variance between the results of the two modes
under favour of the promptitude and searchingness of the oral mode operates as a
check upon error in either of the two modes in the case of inattention
that is to say love of ease, the force of the delinquency promoting
inducement is less, and so is the delinquency restraining motive likewise: in the case
of sinister design, the
force of the delinquency
promoting inducement is
in any degree greater;
but the force of the delinquency
restraining inducement
swells along with it.
