Of the first Second mutual attendances – bilateral First Mutual Attendance.
§.
Art. 1. The Pursuer and Defendant being
not in the his presence of the Judge, the Judge pointing to
the verity promise vice-oath of the taken by the pursuer, as entered
upon the Register, together with and to the punishments in
case of falshood as hung up in the Judicatory, referring
also to the information received by the Defendant
by means of the instrument of summation, or the instrument
of prehension, calls upon him to make a correspondent
verity-promise vice-oath, informing him that in non-compliance
the title right of the pursuer to the service prayed by
him will be considered as established and the correspondent
and of the interpretation put by him on the law be correct, the correspondent
decree, opinative and comparative, will be forthwith issued.
Art. 2. If, for the giving execution and effect
to those same decrees, ulterior information from from the
Defendant shall be desired, the Defendant, in case of</add>
non-compliance, is forthwith committed to safe-custody
until compliance has place.
Art. 3. Statement, under the direction of the Judge
being made by the Pursuer of the facts which if true will
on the ground question of fact establish th his title to the service he demands, question is
put to the Defendant whether any and if any what are
admitted by him to be true: and what, if any, he
denies to be true declares himself to according to his decided
belief, to be true: and whi as to what, if any, his belief
is undecided.
