Constitutional Code
The question interrogatory will, in each instance be addressed either
directly to the individual interrogated, or to the Judge to
the Judge for the purpose of obtaining from him a command an order
addressed to the individual interrogated, and requiring
him to deliver make the answer called for. By The
indirect method time will be saved: and this will therefore
be naturally the ordinary course. But by the indirect
mode irritation will be excluded or lessened. On each
individual occasion it will therefore be for the Judge to determine
whether which of the two shall be employed.
Now will the Pursuer if different from the Applicant, declare
the means of communication with him during the remainder,
if any of the suit.
So likewise the Defendant.
Now if on the Pursuers side further time for
any ulterior operation be in his view requisite, he
will prefer to the Judge a petition for such further
time: the Defendant consenting or contesting as he sees
cause.
Interrogatories may be put Exceptions excepted By any and every actor in the
judicial theatre interrogatories questions may, if openly, be put to any
and every other. Questions Responses Mendacity suggesting questions
will by open to observation their obvious tendency,
their purpose and added by the observaions they draw call forth defeat their
own purpose.
