§. 6. Sittings and Hearings
1. On each enquiry, and in each the original enquiry,
course of the origin initiatory application, and the mutual
attendance respectively, may sittings and hearings may
have of course have place in whatsoever number may happen
to be necessary. Sittings referrs to the time: hearings, to
the suit. Suits in any number may be heard and even despatched
in the course of one sitting. Sittings in any number
may be engrossed by a single suit in which case there is
in the course of a suit no more than one hearing.
Unde this Code there are in the each Immediate Judicatory
as many for sittings as there are days in the year; and
as many night sittings as there are day sittings. Justice
is not less requisite one day than another; nor in
the dark part of the twenty four hours than in the
light part. If a in the character of watchman of a police office a man can officiate
in the night so may a he in that of Judge. The watchman to do his
duty must be all the time awake. Not so the Judge: it is
sufficient if he be liable to be awakened. The Night-sittings
may might accordingly be termed Night-lyings.
As there are indoor-sittings so are there outdoor
sittings. An example of an outdoor sitting is that of a Jury
when on a view. A man may as easily sit out of
doors as indoors: as Judge or Jurymen. But the Judge
wherever he is has a public with him or he would to a tyrant
under the name of a Judge.
