1. Expence by Loss of time. In the
case of the productive and vast majority
composed of the productive and

other profit seeing classes
As in the vast majority expence by loss of time
is the loss by the amount
of its being

would otherwise have
been received.

of expence the first item is that which consists in loss of
time: employ loss of time by employing in the abovementioned
unprofitable ways the time which otherwise might and in
most cases would have been employed in productive labour.

with the difference between what would have been the expence expenditure

1. First suppose him the mode oral, and the Defendant accordingly paying attendance at the Judicature.
Here, as per Ch VIII § supposing him at no expence on this instant account he cannot be destitute of the any
assistance. But if in his view of the matter he stands in need
of a professional assistant of his own choice here will be the
expence of paying for his assistance during the demurrage,
and if to take bring him the in consideration of confidence
derived from previous acquaintance he brings him from home
here in addition to to the time employed in the demurrage will be expence of the
journeys with compensation for the time employed on
them as above.

On the other hand In case of the epistolary mode these items are
in great part saved. But per contra the most no such surely
sufficient assistance being to be had at a distance from or
at the Judicatory, the need of such assistance, or of a
professional proxy instead of a professional assistant will be
more likely to have place in the case of this mode than
in the case of the oral mode.

Art 21 or 13. Mode epistolary, to a defendant even if not of the helpless class, for want of Judge's assistance, professional in default of adequate gratuitous assistance
may be more probably mindful than in the oral mode at the judicatory. But there being no journey the expence will be less.
