to confess indifference
to justice
§ He whose eyes are shut against these proposals is an accomplice
to an all-comprehensive system course of injustice.
That in the case of a vast majority of the people
of England under the present system of procedure a compleat denial of justice has place is as
notorious as the existence of the [sun at noon day] human species itself. For in service of you Over and
again has it in print been declared to be so: in no one
paper that was come out of the press has the truth of the
practice been denied or so much as drawn in to question questioned
Of this enormous abuse sense and substance of all abuse, this lottery fund of unequiment
Over and over again has the system itself been held up to
view as the cause: and of that cause, the abuse as the necessary
effect.
What has also been averred is — that on the part of
those by whom the existing system has been framed and upheld
the existence of the abuse denial of justice has been the result not of inadvertence
but design, that design the result of sinister cabal:
the denial of justice and the enormous profit of those same
functionaries being, and being seen to be, effects of the same
cause.
What has also ben averred is — that not merely in the
general complexion of the system machinery and the system of operators but in every part
of it this is the design planned and executed. That accordingly
such the actual ends of judicature: and standing in diametrical
opposition to the ends of justice.
On the part of the author of these pages a result of
this conviction has been the production of a work proposed having for
its object the exhibition of procedure Code having for its
object the attainment of the ends of justice by giving that a code such as if established would give execution
and effect to a any Code of substantive law to which it were appended.
