Propositions Ch. 1. All comprehensive
(1 §.§§. Existing system

§§. The existing system — its habitudes in relation to the above
subject matters.

Art. If under every system of legislation and
thence in every system of Procedure these several subject-matters
require to have place or will be found to have place
or to require to have place, and if at the same time under
the here proposed system their nature, and what is
proposed to be done in relation to them respectively is brought held up
to view and rendered easily intelligible, the aggregate
here above brought to view will constitute a standard by with
reference to which whatsoever corresponding portion of matter
has place in any established or other proposed system may
be confronted for the several purposes of or say explanations
and trail: explanation for the purpose of shewing what it is;
trial, for the purpose of shewing how far that which is agrees
with that which reference had to the all-comprehensive end
ought to be.

In the established system in general, but most of all in
the English established system, it will be seen how needful this
conformation or say juxtaposition is in the pr were it only in the first place
for the purpose of explanation, the true nature of each subject-matter
being in English practice to such a degree disguised
and rendered obscure by the appellatives in use.

Take for example, the very first article in the list of
the sorts of the Dramatis Personæ or say actors in the Judicial theatre
to wit the Judges. When the time comes, it will be seen that
not are the appellatives under which, as it were
in masquerade the character of the Judge is massed up
and disguised in English practice. + + See below, Ch.
