(3) Procedure

Of the existing system
the hardship & oppression
equally striking with
the extent of exclusion
of good & admission of
bad evidence

Not more unquestionable consequences is the existing System for the extent
it which it excludes greed keeps in exclusion upon and admitts bad deceptive evidence, than
in the cases in which it furnishes power for compelling cred the delivery of testimony/evidence
for then unbounded hardship and oppression by the abuse of this
An same power it has the faculty and gives affords reward for the production
of the Evidence as above not being computable in
any other shape that that of orally delivered evidence, in in no case can evidence
be compelled at the hands of any person without question his being compelled by the
terror of an unlimited punishment to his , and repair
to any distance that may happen to be required not exceeding
that described by an a man whose abode is at the greatest distance from that same judicatory being
at the same time within the boundary line of that part of the United
Kingdom called England. On this occasion & this being for appearance no regard is paid to the
loss in the suffering in any shape unless it be urging to haste
in some cases that may be the result of con non-compliance with
the inexorable mandate. No regard is so much as paid to no security afforded for the
relevancy of the evidence thus called for. Of the persons on whom
the is exercised, the device depends altogether upon
the party, on which side so ever it be, under the advice and direction
of his attorney, whose remuneration being< rising in proportion of the number
of the individuals thus vexed has adds these to the power,
with examples not only for punishment but for , in the
interest in raising the number of instances in which oppression is
exercised and thence the quantity of it to the very highest pitch possible

Under the circumstances supposing on the part of the wrongdoer
grounded in so any one of the multitude of circumstances incidents
capable of affording such an assurance on of
in the suit in such sort that the costs on both sides will fall
upon the lower, he possesses in this way a power to afford to an
unrestricted amount along with the pleasure of gratified malice to his desire
the pleasure of proportionate pecuniary profit to himself.

Thus under the existing system.
