No general fixation of
times for judicial operations —
Delay vexation
& expence the result of
fixation

To For no judicial operation whatsoever [by whatsoever preferable]
should any be fixt by any general ordinance. Delay, vexation
and expence all follows — all the waste of such fixation are the
sure result. In the procedure in and by Justice only out of
system no such fixation has place. Why? because in that case
except by means of individual will no schedule of entrants in judicature
has place.

of necessity — necessary
from the habit of
bandying suits from
place to place

For it is that under the whole of the technical part of it the existing
system such fixation has place not only in fact but of necessity.
Why? because not only has does such schedule of continuity
with wide gaps for the results abound but be so inlapping
in extent suits with parties and proceedings are in the case
and for the purpose of the same suit, banded as above and made to vibrate between
place and place.

Only in one out of an
indefinite number of
cases can the interval
fixt be adapted to the
purpose.

In such suit Only in some one out of an variable and sometimes large and indefinite
number of instances can the interval fixt connect be in connection with
the interval best and most exactly adapted to the purpose. This
exception excepted the interval so fixt is either too long or too short.
If too long, the proportion to the excess in length is the feckless
— the worse than useless delay thus engendered. If too short, then
from one person to another come applications for the enlarging
it. Here then comes a suit within a suit, a first question
in addition to the original one.

Note. The greater part of the book of practice is occupied
about the fixation of these days
