2. Where, in furtherance of the intention,
mendacity is employed, either as the sole instrument,
or in concurrence with others: for
even in case of competition, mendacity will be had
been shown to be productive of evil, and neither
necessary nor conducive, to the production
of good in any case. If then, the bare intention
to produce pain, without any justificative
cause may be with reason be considered
as giving to the act, the character of
a punishable offence, mendacity employed
in prosecution of such intention may likewise
be considered as making addition
to the evil and constituting an efficient
cause of aggravation, in respect to the demand
for punishment for the repression of the
offence.
