2. Afflictive information. If, in
any material respect the information is false,
the falsehood, according as it is accompanied
with evil consciousness, temerity or negligence,
constitutes an efficient cause of aggravation.
Even if the information is correctly true still,
if affliction, to any person, without preponderant
good to any other is meant to be produced,
by the information, it may form the matter
of an offence.
