In the case of immoveables, the efficient cause
of title to property is as above observed of a much
more simple nature. It is designated by the word
possession, for in this case, by possession, a
presumptive title to the subject matter possessed
is created and conferred; – a presumptively good
title, howsoever in many cases, it may eventually
be found a defeasable one. The title
The title will in these cases be commenced
by delivery, on the one part, receipt on the other;
and continued by a tissue of surrounding circumstances,
affording presumptive evidence
of the habit of occupation.
To exhibit a list of the several circumstances
that have the effect of efficient causes of
title as applied to different matters is the busines
of the civil or say non-penal code. On the
present occasion, what requires to be brought to
view will for the most part be reducible to those
offences, of which deeds and the several operations
performed by means of them, or in relation to them,
see the subject matters.
These will manifestly form a form a
subject of consideration plainly distinguishable from
those by which the possession including the occupation,
use and value of them is effected: the title being
no otherwise affected than in so far as possession is effected.
