Case B. Case of him who, by mans of the expence is prevented
from acting in the capacity of Defendant.

In This condition The time at wh it may happen to a man to find him
The time at which it may ha this may be a man's condition
is that of the commencement of the case suit, or any time
in the course of it. In Whatsoev At any one of these times
as at any other, [whatsoever be the amount of the destined victims
property,] the factitious expence on with which the defendant's side is loaded is
an instrument the use of which is sold by the existing system
to the oppropr every oppressor who will pay the price for it
an instrument with which the whole of the destined victims
property may be torn from him, whatsoever be the amount of it.

In this generally speaking consists the whole of the mischief
capable of being done to a man by the instrument. Of To suffering
in any of the shapes in which it is inflicted by the hand of law
on the ground score of punishment, a man could not be subjected
otherwise without the help of perjury.

The three distinctions
brought to view in case

Consequently in this case do not apply the three distinctions which
he above brought to view as applying to the case where the
it is to on the plaintiffs side that the factitious bar to justice is
opposed.
