Of Confinement
12
From p. 36. Specificati Specification of the most common purposes. The most common purposes for which confinement
is unlawfully inflicted or likely to be inflicted seem to be as
follows
13
1. To govern on pretence of insanity 1. To maintain an absolute controul over
the person and fortune of a wife, husband, parent, child or brother, sister,
or other near relation on pretence of insanity.
To guard against this kind of abuse requires certain
local regulations concerning insane persons,
& concerning public and private mad-houses.
This kind of oppression is seldom exercised upon
persons in perfect health of mind and whose behaviour
entertains affords no ground whatsoever for the
imputation on which the injury is founded. The
most common case is where there is some little defect
in the understanding of the person so oppressed,
though not such as is sufficient to warrant the
oppression coercion actually which is applied. To p. 43. last paragraph
