Diss. Refusal of Trusts
of desire competition , than of refusal ; not indeed of themselves ,
but what comes to the same thing in virtue of the
emoluments which come of course to be annexed
to them . Even those which have not necessarily
any thing to do with property , and which therefore
do not necessarily afford whereas that to yield
an emolument to the Trustee , such as those which
belong to the relations of Guardian , Executor , Administrator ,
and in case of the poor , tCounsillor
Advocate and Attorney , are not constantly objects
of refusal . Sympathy , cemented fortified strengthened
by consanguinity , affinity or compassion , commonly
enough provides persons who are willing content , without
any pecuniary profit to take upon them
the exercise of those laborious trusts . But the
Law which whose office business it is to provide against
the worst contingencies , and combat the most
perverse dispositions , can not trust to the uncertain
operation of such variable causes . It
must provide by some means or other in every case some person
or other who at all events shall be obliged to
take upon him these necessary occupations . This
it can only do by compulsion ; thereby creating
so many sorts of offences as there may be are trusts of
which it can be found necessary to compel a man to
