Of Simple Mercantile Defraudment
1 From p. 4 to distinguish fraud from negligence: and out
of tenderness an offence which originated in reality
in the first of those motives, former motive may be attributed
to the other. Punishment for as for negligence
may in such case be consider'd on
the footing of a punishment as for fraud, but instigated
pro modo probationum. If any further punishment be needed for a second offence, the publication of the offender's name (together with an account of the offence, in) in a manner more or less public & extensive (for instance by advertisement in a newspapers, or by proclamation in the market place, will answer the design.
The demand for use of such a provision
is more particularly obvious in regard to
such commodities as are in universal and
continually demand: such as bread, butcher's
meat, and such other articles as in the
respective countries that are in question in which they are used
are commonly ranked among the necessaries
of life. The fine will need of course to be different
according to the nature of the commodity
and the value of money in the country. To p. 8. 13. No 2
