4. C Of Culpable Insolvency
Punishment for Insolvency fraudulent ab initio . Punishment may be of the same nature as for Sharping ordinary Defraudment. . In very
atrocious cases it may be treated in point of punishment
altogether upon the same footing . But in general the vague intention
of paying at some time or other, though upon improbable
contingencies , may be accepted as an excuse extenuation . . In this Case, instead
of the ignominious punishment for sharping , the Offender
might be made to wear a coat of a particular appearance
to be called the knavish Insolvent's Coat . (a) (a) In Scotland it has been the custom for Insolvents without distinction to wear a coat of a particular appearance . See Stairs Institute. Of late the custom seems to have fallen into .
Punishment for Insolvency through Rashness ab initio. For Insolvency through Rashness ab initio the Offender
might be made to wear a for a certain time a coat of a particular
appearance to be called the Rash Insolvent's or The Adventurer's Coat .
Punishment for Insolvency through Prodigality or Gaming. For Insolvency through Prodigality the Offender might
be made to wear for a certain time a Coat of a particular appearance
to be called the Prodigal's Coat . If any part of the
Prodigality had consisted in Gaming the appearance of the
Coat might be varied accordingly , and it might be called The
Gaming Prodigal's Coat. To this might be added solitary confinement
to hard labour and spase diet , for not more than three
Months ,(a) at the direction discretion of the Judge. For
