1 C Misbehaviour of Trustees . Breach of Trust
Misbehaviour in a Trustee Breach of Trust is where
a person having received a trust to execute being entrusted to do any thing for
the benefit of another party person fails to promote
in any respect in which he was bound , the ends design of the institution .

Misbehavour may be incurred either from
either of these causes : incapacity , indolence ,
or in corruption : if from incapacity it is mischievous
When it arises from incapacasity the but perhaps not blameable ; it is blameable
only in the case of the a n party's being conscious
of his incapacity : if from indolence it
is blameable and perhaps criminal : if from
corruption it is criminal beyond dispute .
When it proceeds It is said to proceed from corruption
where it proceeds either for being accompanied with the criminal
consciousness which : the criterion of guilt
it proceeds from some active principle or scar of giving offence : i'e - a species of self-preservation . : to

equivalent to it or from a desire of gain
or what is equivalent to it
When it proceeds from incapacity the
