C 15 Of Justifications.
A combat may be either of the higher order, viz a duel; or of the lower order
A combat may be distinguished into a
combat of the higher and a combat of the
lower order. It may be termed a combat of the
higher order when weapons are made use of, and
those of such a nature that the pain or uneasiness
produced by them is usually commonly attended with
death; and those made use of in that manner
in which when used they are the use of them is commonly attended
with that consequence. S Such a sort of combat
is what is commonly termed a duel. It
may be termed a combat of the lower order
when either no weapons are made use of, or
those not of a mortal nature, or not used in
a mortal manner.
